The 10th Amendment is alive and kicking and has primed over Commerce Clause in a Louisiana House committee today.
The Louisiana House Insurance Committee Tuesday approved a constitutional amendment claiming the 10th Amendment of the US Constitution primed over the commerce clausegranting state’s right over health care, specifically,The recent healthcare bill passed by the democratic dominated Congress and signed into law by President Obama.
The vote was 5-4 vote.
The focus of the bill is to prevent the imposition of federal health care requirements or “mandates“ upon businesses and citizens of Louisiana.
Governor Bobby Jindal supported the legislation or HB 94.
Louisiana is also one of the states which is contesting the recent federal health care law in the courts.
Discussion in the hearing also focused on past powers of the Commerce Clause which proponents of the health care bill believe cover the federal right to compel the purchase of insurance.
Some proponents are comparing the federal intervention into health care to be similar to the federal intervention during the civil rights days.

Health care for all is the right thing to do. Acting as though our resources are unlimited and allows us to do everything, is not. If we prioritize what we actually CAN do, we would have universal healthcare, and adaquate flood protection. We would not - IMHO - be able to afford all the foreign aid we currently have, or the subsidies to millionairs (or billionairs) we now have, or build aircraft, VA hospitals, etc. that the military says they do not want, nor would we create public sector jobs as political payback or to ensure a loyal voting base. We can afford to do the important things - and run a balanced budget - ONLY if we eliminate the wasteful spending. As it is for you and I, and all other lower and middle class Americans with their personal budget, so too it is for government; or rather "should be" for government. Instead, we are going down the path to financial ruin. You are wrong about me worried about MY finances - I'm plush - I lose no sleep over my personal financial future - not a wink - EVER, rather it is this country's future our deficit spending is jeapordizing. Now if a person wanted to sit down and speak of rational approaches to the situation, be glad to oblige.... . . . At its core, health care is a good thing, it is something that can be done, and costs to the taxpayer can be alleviated if not out and out made non existent.... I mean hell, a person can't expect something for no effort at all can one? So time to figure out how to make it work.....
